Second four, first repetition of the first theme: is that a mistake?
If so, does he decide to play with it and create a new rhythm?
What time signature is the arpeggio part in?

What do you mean by second four?
Just listening to the opening and whoever is playing (Stu or Joey) definitely makes a mistake in the second repetition of the riff and that throws off the remaining repetitions until they switch to the second chord.
There may be another way to count it that I’m not hearing but you can count it in 4/4.
